You read that right.
Because HB1325 was passed June 25, 2019 making Hemp legal in Texas (CBD oil is now legal too) there is no current way to determine if a substance is CBD or THC. This creates issues for prosecutors offices because it will take months for DPS to create the systems and protocols for testing. So rather than wait, the Fort Bend County District Attorney's office is dismissing all misdemeanor marijuana cases. Click here for an article explaining this position from the Fort Bend County District Attorney, Brian Middleton.
So if you had a misdemeanor possession of marijuana case you were suppose to appear in court or have already appeared in court and have a new court date- your case is getting dismissed. Felony possession cases will be evaluated on a case by case basis.
Curious about what this new law means if you have a probation violation with marijuana or CBD oil- click here.
