Because HB1325 was passed June 25, 2019 making Hemp legal in Texas (CBD oil is now legal too) there is no current way to determine if a substance is CBD or THC. This creates issues for prosecutors offices because it will take months for DPS to create the systems and protocols for testing. So if you had a misdemeanor possession of marijuana case you were suppose to appear in court or have already appeared in court and have a new court date- your case is getting dismissed. Felony possession cases will be evaluated on a case by case basis.
